Individualised Training for Specific Employees or Employees Subject to a Disciplinary Procedures or Harassment Claim
Even when an employer has diligently implemented a comprehensive harassment prevention programme, there can still be some employees who don’t fully recognise or understand the importance of conforming to and complying with the law and company policy against bullying and/or harassment. In these circumstances the company may wish to engage the individual in separate one-on-one coaching and training as part of the disciplinary and remediation process. This form of training allows our trainer to dedicate time working specifically with a particular individual to ensure they understand the boundaries between acceptable and unacceptable behaviour within the workplace and/or other work-related environments and the consequences of crossing the line (whether that be action taken by the company against the individual or a more formal employment claim by the victim against the individual). In addition, such training provides an employer with a statutory defence at Tribunal against any harassment claim arising out of the relevant facts/incident as it indicates that the company has made a good faith effort to prevent harassment. This defence can usefully mitigate the risk of liability for the employer and/or any word of damages.
